Please read carefully before booking.

Overview

These Terms and Conditions ("Terms") apply to all travel products and services offered by Nomadz Trips and govern the contractual relationship between you (the "Client") and Nomadz Trips (the "Company").

By booking any product or service with Nomadz Trips, or by traveling on a Nomadz Trips experience, you confirm that you have read and understood these Terms and agree to be bound by them.

If your booking includes more than one traveler, the person confirming the booking accepts these Terms on behalf of all travelers listed, including minors and those with disabilities. That person is also designated as the primary contact for the booking. These Terms constitute the entire agreement between you and Nomadz Trips and supersede all prior agreements, written or oral.

These Terms apply exclusively to trips organized entirely by Nomadz Trips and do not apply to trips operated in conjunction with third-party tour operators.

The Booking Contract

A booking is confirmed and these Terms take effect when Nomadz Trips or an authorized agent receives your deposit and you receive written confirmation from us.

The person confirming the booking must be at least 18 years old and must provide accurate, complete information. By confirming on behalf of a group, you represent that you have the authority and consent of all travelers, that the information provided about each traveler is accurate and complete, and that all travelers have been informed these Terms apply to the booking.

Nomadz Trips reserves the right to decline any booking at its sole discretion and may adjust prices at any time before full payment is received.

Confirmation & Itinerary

Once your deposit is received, you will receive a confirmation email within five business days. Please contact us if you do not receive it within that time.

The itinerary provided is a general guide and is subject to change. Nomadz Trips reserves the right to modify any part of the itinerary at any time due to third-party availability, weather, local conditions, or other circumstances outside our control.

Payments

a) Full Payment

The total trip cost must be paid in full two months before your departure date. Your specific payment schedule will be communicated at the time of booking. If full payment is not received by the due date, Nomadz Trips may cancel your reservation, and any amounts already paid will be forfeited. All payments are non-refundable and non-transferable to a different trip.

b) Deposit

All deposits are non-refundable. However, you may hold your payments as a credit or transfer them to a future trip of your choice if you cancel. You may also request to have your deposit applied to another participant registration for the same trip before the Payment Due Date, but you are responsible for finding that participant.

c) Payments After the Deposit

Cancellations made 30 to 60 days before departure are subject to a 50% cancellation fee on all payments made after the deposit. The remaining 50% will be issued as a credit toward a future trip. Cancellations made within 30 days of departure result in a 100% charge on all post-deposit payments.

d) Late Payments

Payment not received within ten days of the agreed date is a breach of contract and may result in cancellation of your booking. If you anticipate a late payment, you must notify us immediately at support@nomadztrips.com. A $30 late fee applies. Nomadz Trips reserves the right to offer your spot to the next eligible client on the waitlist. Any additional costs incurred when re-booking a cancelled trip are the traveler responsibility.

Cancellations by the Client

All cancellation requests must be submitted in writing and acknowledged by Nomadz Trips in writing to be valid. We strongly recommend purchasing travel insurance to cover cancellation-related losses.

Cancellation terms:

• 60 or more days before departure: you may cancel or amend your trip. Any difference in trip cost between your original and new booking still applies. Your balance will be transferred as a credit toward a future experience or destination.

• Less than 60 days before departure: standard cancellation fees apply as described in the Payments section.

• Private experiences: cancellation may be subject to additional fees if accommodation or activities have already been booked and are non-refundable by our partners.

Credit balances are valid for one year from the date of issuance. If a cancellation is made 60 or more days before departure, the credit is valid for six months from the cancellation date.

Installment Transfer Option

You may transfer your installment payments to another participant for the same trip before the Payment Due Date. You are responsible for finding that person. The new participant must sign the waiver and cancellation agreement. A transfer admin fee equal to the total deposit amount applies to all such transfers.

Refunds

All deposits are non-refundable. All other payments are non-refundable seven days after they are made, including installment payments, late fees, and full payments.

The only exception is if Nomadz Trips cancels the trip in its entirety. In that case, all affected clients will be notified by email with refund instructions.

We are not responsible for any incidental or consequential expenses you may incur as a result of a cancellation, including visas, vaccinations, non-refundable flights, car parking, loss of earnings, or loss of enjoyment.

Our vendors require upfront, non-refundable commitments. When you book with us, we make those commitments on your behalf to secure your spot and ensure your experience.

Unused Services

No refunds or discounts will be provided for missed or unused services due to the client own actions, decisions, or negligence. This includes cases where a client voluntarily opts out of activities or is removed from the trip due to a breach of these Terms.

Passports, Visas & Travel Documents

You are solely responsible for obtaining and maintaining a valid passport and all required visas, permits, and other documentation for every destination on your trip. Nomadz Trips is not liable if you are denied entry or exit from any country due to missing or invalid documentation.

Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance at the time of booking.

Your insurance should cover:

• Trip cancellation and interruption

• Medical emergencies, evacuation, and repatriation

• Baggage loss or delay

• All physical activities included in your trip itinerary

You are solely responsible for the cost of your travel insurance and any losses arising from inadequate coverage. Nomadz Trips is not liable for losses, costs, or damages sustained during the trip.

Changes or Cancellations by Nomadz Trips

Trip Changes

Nomadz Trips reserves the right to modify any aspect of a trip at any time, including activities, hosts, accommodation, itinerary, and timing. This may occur due to hazardous conditions, third-party actions, or other commercial reasons. No refunds will be issued for changes made under these circumstances.

Trip Cancellation by Nomadz Trips

Nomadz Trips may cancel a trip if insufficient registrations are received or for other commercial reasons. In such cases, you will receive a full refund of amounts paid to us. However, Nomadz Trips will not be responsible for any other costs, including flights, travel documents, or other expenses.

Cancellation by You

All cancellations must be submitted in writing to info@nomadztrips.com. Cancellations received before the Payment Due Date will be refunded, minus your non-refundable deposit. Cancellations after the Payment Due Date forfeit the entire amount paid.

Flexibility

Travel by nature involves uncertainty. By booking with Nomadz Trips, you acknowledge that routes, schedules, accommodation, and transport may change without notice due to weather, mechanical issues, political events, border difficulties, or other factors outside our control.

Health, Fitness & Assumption of Risk

Voluntary Participation in Physical Activity

Nomadz Trips experiences may include physically demanding activities such as hiking, swimming, surfing, yoga, climbing, and other exercises. By booking, you acknowledge the associated risks, including the possibility of serious injury or death, and voluntarily choose to participate. All activities are optional.

Health & Fitness Eligibility

By booking, you confirm that you are 18 or older, in good physical and mental health, and capable of participating in the trip and its activities.

• You do not have any medical condition that would prevent or limit your participation

• You have consulted your physician and have been cleared to participate

• You will seek appropriate medical guidance before departure if you have any health concerns

Nomadz Trips reserves the right to refuse participation to any client on medical, fitness, or behavioral grounds at any time, including during the trip.

Remote Locations & Medical Access

Some trips take place in remote areas with limited or no access to medical facilities. All medical and evacuation costs are your sole responsibility.

Assumption of Risk, Injury, and Waiver of Liability

You assume full responsibility for all risks associated with travel and physical participation in the trip, whether foreseen or unforeseen. If you are injured during the trip, you agree to assume all financial responsibility for medical costs.

In consideration for participating in the trip, you voluntarily release, waive, and hold harmless Nomadz Trips, its officers, agents, employees, contractors, volunteers, and guides from any and all claims, losses, or liabilities arising out of your participation in the trip or related activities, to the fullest extent permitted by law.

Indemnity & Binding Effect

Indemnity

You agree to indemnify and hold harmless Nomadz Trips and its representatives from any liabilities, including legal costs, arising from your participation in the trip. This includes any failure to disclose relevant information at the time of booking, such as dietary requirements, allergies, or other special needs.

Binding Effect

This Agreement is binding on you and, as applicable, your family, heirs, and personal representatives.

Pricing & Validity

Prices are based on costs at the time of publishing. Nomadz Trips reserves the right to change prices at any time before full payment is received. The price confirmed at the time of booking is your applicable price, subject to any applicable surcharges noted in these Terms.

Client Responsibility

You acknowledge that travel, particularly adventure travel, involves a degree of personal risk. By booking, you confirm that you have assessed the risks in light of your own capabilities and are willing to accept them.

Nomadz Trips is not responsible for providing guidance on local customs, weather, safety concerns, or local laws. We encourage all clients to contact their local embassy or consulate for each destination before departure.

Images & Media Release

Photos and videos may be taken during the trip by other clients or Nomadz Trips representatives. By participating, you grant Nomadz Trips a perpetual, royalty-free, worldwide license to use your image and likeness for any lawful purpose, including marketing and promotions, across all media, without additional compensation.

You waive the right to review or approve materials in which your likeness appears, and you waive any right to royalties or compensation from such use.

Group Photos

Trip Managers may organize group photo opportunities. These photos may be shared on Nomadz Trips social media channels for promotional purposes. If you prefer not to be included, please remove yourself from group photos when they are being taken.

General Conditions

• All clients must comply with the rules, regulations, and laws of any service provider, country, or government authority applicable during the trip.

• Nomadz Trips reserves the right to refuse service to any client at any time, for any lawful reason, at its sole discretion.

• These Terms constitute the entire agreement between you and Nomadz Trips regarding the subject matter herein and supersede all prior agreements or representations.

• If Nomadz Trips is prevented from fulfilling its obligations due to circumstances beyond its control, it may cancel or modify the trip and will not be liable for additional costs incurred.

• These Terms are governed by the laws of Sao Paulo State and subject to the exclusive jurisdiction of Sao Paulo courts.

• If any provision is unenforceable, it will be modified to the minimum extent necessary and all remaining provisions will continue in full force.

• Failure by Nomadz Trips to enforce any provision does not constitute a waiver of that or any other provision.

Disclaimer

By purchasing a group trip experience, you accept and understand that trip details are subject to change. The itinerary is a general guide only and does not guarantee visits to any specific destination. While every itinerary is crafted with care and good faith, adjustments may be made based on weather, local factors, traveler feedback, or other considerations, always with the goal of delivering the best possible experience.

We recommend printing or saving a final copy of your itinerary a few days before departure to account for any last-minute updates. You also acknowledge and accept the inherent risks of physical activities you may participate in during the trip.
